when i started my job i didnt have my p45. so my employer gave me an m1 tax code. i assumed this meant my employer would have to apply to the HRMC for a perm tax code, but after 7 months this never changed from m1 status.
Ive since been made redundant and not received a p45 from them and applied for carers allowance, which they havent completed my earnings form that the dwp requested from them.
Im now getting suspicious and thinking all the tax they took off me each month - have they actually declared it from the HMRC and this is why i never got a perm tax code? Also is this why they wont complete the earnings form the dwp sent them - because they thought they%26#039;d get caught out?? When i phoned the tax credits they seemed a bit off with me when they questioned me regarding employment, i just hope everything doesnt look to the hmrc and dwp as though i have had no employment for the last 7 months because my employer was pocketing my tax each month - what are your ideas??

It is not part of your employer%26#039;s obligations to sort your tax code. That is your job. Have you asked employer for form P45? If he says it has been issued, but you didn%26#039;t get it, he isn%26#039;t allowed to do a duplicate, but he can give you a signed letter on headed notepaper, showing the form P45 information.
If this doesn%26#039;t happen, you can contact tax office, quoting your National Insurance number, and see if information held there. If so, get similar letter from there. This should satisfy DWP. You can also check to see if he has registered you as one of his employees. If not, tax office have forms they can send him. If he doesn%26#039;t answer, there are further measures they can take, but it does take a long time. Do you have payslips from your employment. If so, keep them. They may be of use if tax office needs to pursue employer, and they will show tax has been deducted.
The annual employers%26#039; returns are due in after 6th April. Your employer should include you on this. The information unfortunately takes months to filter through the system until it gets on your record.

Get in touch with your local HMRC. You need to ensure they paid your NI contributions. Give them a copy of your payslips and bank statements.

Its you responsibility to give HMRC the information they need to take you off the M1, (emergency code), so there is nothing suspicious in the fact that your employer had you on this code for 7 mths.
You do need to get your P45 from your employer, so ring them and ask them when you will receive it. If you don%26#039;t receive it in 14 days, inform HMRC.
If you employer has not been paying the tax and NIC over to HMRC, he is the one in trouble, not you.

It sounds as though he wasn%26#039;t declaring that you worked there and your wages were cash in hand - contact inland revenue and ask them.
