we are married in our 1st year. I owe child sopport and the irs will take my tax credit. I am wanting to file married but seperately so that the irs will not take my wifes tax credit for my child sopport, am i thinking correctly?

File Jointly to be able to claim all the credits and deductions that you are entitled to. File the form 8379 for you wife to get her portion of the refund and credits that are attributed to her income

I hope it%26#039;s better in the States than in Canada. In Canada, married couples get the royal shaft at income tax time and I rather expect that Americans do also.

It depends on your tax status as to whether filing separately is beneficial. If you want to file as married filing jointly, your wife can complete an %26quot;injured spouse%26quot; form. That way the IRS will not take that portion of the refund that is attributed to her. Speak to a tax professional or the IRS about it. You can still file married filing jointly...



You will need to file form 8379, which is an %26quot;injured spouse allocation%26quot; form.



After you complete your return, you fill in this form and state which parts of the return are yours %26amp; which parts are your spouses. If you are in a community property state, that will also be taken into consideration....The IRS states that all withholdings in a community property state were paid by both spouses equally, even though in actuallity one may have paid more withholding than the other. This basically will protect half of the refund (or your spouses portion) from being used to pay your arrearage.



When you do this, you have to write %26quot;INJURED SPOUSE%26quot; on the top right corner of the first page of your 1040.



Doing it this way will always come out with more of refund that filing married but separate.
